Rationale
The recognition of the scarcity of water has elevated the legal and political significance of the management and sharing of water resources. Water Resources Law aims to give graduate students an advanced knowledge of the legal frameworks for sharing water resources in Australia under State and Territory law. Students will develop advanced writing and communication skills in the detailed articulation of the legal and policy aspects of water resources management. The course is available in the Master of Laws, Juris Doctor and Bachelor of Laws Honours.
Synopsis
Water Resources Law deals with historical observations on the evolution and development of Australian water resource policy reform; the establishment of statutory water resource planning and the transition to new water access rights regimes; water access rights at common law; the contemporary statutory foundations of water access rights; the water resource planning system; and the law and policy of water trading in Australia. It is delivered intensively in four seminars over two weeks (two seminars in each of two weeks), and will involve closely supervised research assignments.
Objectives
On successful completion of this course students will be able to:
- evaluate developments in chosen areas of water resources law, and critically examine the relationship between those developments and contemporary theory or practice (PO 1);
- demonstrate advanced knowledge of the impact of globalisation or other legal systems on the substance, theory and practice of Australian water resources law (PO 2);
- undertake, interpret and evaluate research concerning water resources law using advanced legal research methodologies and techniques (PO 3); and
- 4. articulate advanced knowledge of water resources law in written presentations (PO 4).
